UTAH U.S. ATTORNEY REMOVED FROM SWALLOW INVESTIGATION:
In a stunning development the Utah U.S. Attorney's office has been removed from the investigation of Utah Attorney General John Swallow. The removal comes just 3 days after several defendants in another case filed opposition in a Nevada court where the Utah U. S. Attorneys office sought a stay of discovery citing it would "wreak havoc with the government’s criminal case". You can download the entire filing here.
In the filing the defendants point out what they claim are the real reasons the Utah U.S. Attorneys office wants to keep them from deposing witnesses the government intends to use in the criminal case. Using several affidavits from the governments own witnesses in the filing, the defendants show how FTC attorneys were able to falsify testimony used to seize and ultimately sell their assets. The filings also detail how attorneys in the U.S. Attorneys office sought to protect Swallow in a strange immunity deal that ultimately failed.
A hearing has been set for June 1 to see if the government will be able to prevent witnesses from being deposed in the case.
